What 'Uncontested' Actually Means
An uncontested divorce is one where both spouses have fully agreed on every issue: division of marital property and assets, responsibility for marital debts, child custody and parenting time, child support, and spousal maintenance.
If you disagree on any of these — even one — your divorce is contested, not uncontested, and you'll need different representation. We'll tell you honestly at your free consultation whether your situation qualifies. We only handle uncontested divorces.

No-Fault Divorce in New York (DRL §170(7))
New York allows no-fault divorce under Domestic Relations Law §170(7). The ground is 'irretrievable breakdown of the marriage' for at least six months. Either spouse can obtain a divorce without proving fault — no need to establish abandonment, cruelty, or adultery. For virtually all uncontested divorces, this is the right ground, and it's the one we use.
If Your Spouse Won't Sign
If your spouse refuses to sign the agreement or disputes any of the terms, your divorce is contested — and we are not the right fit for that stage. We'll tell you clearly and help you understand your options. Our practice is limited to uncontested divorces.
What the Settlement Agreement Must Cover
Equitable Distribution
New York is an equitable distribution state — marital property is divided fairly, not necessarily equally. The settlement agreement must clearly address all marital assets and debts.
Child Support
New York's Child Support Standards Act establishes a formula based on combined parental income. Agreements that deviate from the formula must state the parties are aware of the guideline amount and explain the agreed deviation.
Spousal Maintenance
New York's maintenance guidelines provide a formula for spousal support. Parties can agree to a different amount. The agreement must address maintenance clearly — including its duration and conditions for termination.
Frequently Asked Questions
Do both spouses need to hire a lawyer?
No. One attorney prepares the documents and handles the filing. However, that attorney represents one spouse, not both. If your spouse has significant questions about the agreement, it's advisable for them to have it independently reviewed before signing.
Can one lawyer represent both of us?
In New York, an attorney cannot represent both parties in a divorce — even an uncontested one. One attorney prepares the documents for one spouse; the other may review with their own attorney if they choose.
How long does an uncontested divorce take?
After all documents are signed and filed, most uncontested divorces are processed within 8–14 weeks. Timelines vary by county.
What are the residency requirements?
At least one spouse must generally have lived in New York for at least two years before filing, or one year if the marriage took place in NY, the parties lived in NY as a married couple, or the grounds arose in NY.
What if one spouse is in the military?
Active duty military divorces involve additional protections under the Service members Civil Relief Act (SCRA). Please let us know upfront if one spouse is on active duty.
What if we change our minds after we've started?
If new disagreements arise during the process, the case may no longer qualify as uncontested and additional work may be required. We address this directly if it happens.
